Cornwall
Sustainable Energy Partnership (CSEP) was created in November 2001 to
combine the expertise and knowledge of organisations within the public,
private, health and community sectors. Over 72 partners have now signed
the 2004 Energy Strategy for Cornwall with the aim of ensuring a
sustainable future for Cornwall.
Regen SW

Regen SW is the sustainable energy agency for South West England.
Our mission is to speed up the transition to a low-carbon economy in South West England, by:
* unlocking sustainable-energy business opportunities
* accelerating the uptake of the region's renewable energy resources
* and championing effective energy-demand-reduction initiatives in the region.
We
help develop all aspects of the sustainable energy industry in the
south west by giving independent advice to decision makers; acting as a
sounding board for developers; supporting demonstrator projects across
a range of technologies at both micro and utility scale; and
stimulating an informed public debate about sustainable energy.
Regen
SW is a not-for-profit company, with both its membership and its board
of directors comprising representatives from the private, voluntary and
public sectors. Core funding for Regen SW comes from the South West of
England Regional Development Agency. The Regen SW team is based in
Exeter. Geographically we cover the seven counties of the South West:
Cornwall, Devon, Dorset, Former Avon, Gloucestershire, Somerset, and
Wiltshire.

In
the current challenging economic circumstances, we are working hard
with our regional partners to develop or expand a number of initiatives
to help businesses and the wider economy respond to these testing times

Cornwall Sustainable Building Trust

CSBT
is a charitable company committed to making building design and
construction as sustainable as possible, with minimal negative impact
on the environment, both locally and globally.
Renewable Energy Co-operative R-Eco are a Renewable Energy services company with a difference. We
recognise micro-generated renewable energy as a key solution to the
current and future energy, environmental and financial problems that
have grown from our addiction to fossil fuels. Transition Penwith Transition
Penwith is a new initiative that works to engage all sectors of the
community in addressing two of the greatest challenges of our time:
climate change and fossil fuel depletion. Its aim is to become a hub
that co-ordinates and catalyses the research and ideas of a diverse
network of groups, organisations, associates and individuals from the
private, public and community sector. Transition Penwith seeks to
facilitate creative and pro-active responses, with the ultimate aim to
strategise and implement an Energy Descent Action Plan for a vibrant,
low energy, low carbon Penwith.
As
a not-for-profit company and a social enterprise, we are concerned not
just with delivering high quality, competitively priced Renewable
Energy systems.
We strive to actively engage with the
communities within which we work, providing information, education and
raising awareness of energy issues.

Low-carbon
technology development and implementation will not only help to rebuild
our economy, it is the only long term solution to today's environmental

IcS Renewable Solutions Terms & Conditions
Definitions:
For the purpose of these terms & conditions the following words shall the following meanings:
1.1: ‘we’, ‘us’, ‘our’, ‘the company’, refers to IcS Renewable Solutions.
1.2: ‘you’, ‘your’, ‘the buyer’, ‘the customer’, ‘the client’ shall
mean the person(s) or organisation for whom the company agrees to conduct
business with or refers to signatories on the purchase order (or order).
1.3: the ‘operative’ or ‘engineer’, shall mean the representative appointed by the company.
Agreement:
2.1: IcS Renewable Solutions of Hellangove Vean, Gulval, Penzance, TR20 8XD, have agreed with you that we shall supply & install the system, sub-system or component described in the purchase order (or Order).
Customer Responsibility:
3.1: You will allow / afford us access, during normal working hours to undertake the agreed work described in the contract or order. This may be amended in accordance with paragraph 4.6.
3.2: In order that we may carry out the contract / order, you agree to co-operate with us regarding access to the premises & other reasonable requests relating to the installation.
3.3: You will obtain all necessary approvals, consents & / or permissions including, if necessary planning permission, building regulations, permissions from landlords etc, which are required before work can commence. At our request you will provide us with copies of all relevant / pertinent permissions, approvals & / or written consents so that our system design is able to comply with any / all regulations.
3.4: We will provide you with operational & maintenance guidance (where appropriate). We will not take responsibility for any neglect on your part for insufficient care of goods resulting in system, sub-system or component damage, failure or reduction in efficiency.
Our responsibility:
4.1: We will comply with all health & safety regulations when conducting an installation.
4.2: We will undertake installations in accordance with best practice guidelines.
4.3: We will respect your property & conduct our business in a proper manner.
4.4: Quotations / estimates will be provided to you without costs. There is no obligation for you to complete a purchase order as a result of a quotation / estimate.
4.5: Where ‘cost-estimates’ are given, these will clearly be labelled as being different from a quotation.
4.6: Reasons beyond our control may require us to amend the original order. If this causes an increase in the costs, we will define (in writing) these costs & provide an explanation for variance in costs. We will only continue with the agreed order / contract either previously agreed or additional work after receiving written confirmation from you.
4.7: Quotations / cost estimates are valid for a thirty (30) day period only. If after this time no order has been placed with the company the quotation / cost estimate may need to be recalculated.
Financial Arrangements:
5.1: The total price is stated in the order, along with VAT & any other applicable taxes that are payable at the prevailing rate.
5.2: The order is confirmed when a deposit has cleared into the company’s account.
5.3: You are responsible for paying the full balance upon satisfactory completion of the order.
5.4: Failure to complete payment / pay any sum owed to us will result in interest being charged on the sum at a fixed rate of 8% above HSBC’s base lending rate at the month in question; from the date money is due.
5.5: You will be responsible to pay for any fines associated with any of your payments which have insufficient funds available in your account(s).
Installation:
6.1: We will aim to complete installations within the timeline / frame given / estimated.
6.2: If we can not complete our obligations to you due to adverse weather conditions (as example) we will propose alternative dates, aiming to complete the installation as soon as is reasonably possible.
6.3: Any part of the system, sub-system or component we remove at your request, we may not be able to remove intact.
6.4: If we find upon installation that any part of your existing system, sub-system or component is illegal, unsafe, damaged or unusable; we will inform you of this. The concern must be corrected at your cost.
6.5: We deem measurements provided by you to be accurate. If information given by you to us is found to be inaccurate upon installation, you are liable for any increase in costs or work associated as a result of your error.
Cancellation Rights:
7.1: You can cancel your purchase order at any time before the commencement of the installation begins. Cancellation must occur in writing. However, you will be liable for any costs that have been occurred due to any items manufactured, ordered or delivered to you or us.
7.2: If you cancel within seven (7) working days a full refund on your deposit will be made.
7.3: Cancellation after seven (7) working days will result in the loss of your deposit & further costs incurred as detailed in paragraph 7.1.
7.4: We reserve the right to cancel installations at anytime if the installation can not be undertaken due to technical reasons unknown at the time the order was placed, or where we state a design or safety issue or other implications with which you do not agree. If we do all monies paid to the company will be returned to the customer.
Returns:
8.1: A handling & restocking fee of 25% of the purchase price will be charged for goods that you return if they were ordered in error or are no longer required / desired by you. This fee is not charged if the goods are either found to be faulty, damaged & proved by the original equipment manufacturer as so, or if it was our mistake.
Warranty:
9.1: Our equipment is delivered / manufactured by a number of suppliers. The main system components all come with a manufacturers warranty covering the requirements of the Supply of Goods Act (1982). If a warranty claim needs to be made we will administer this process for you with the equipment manufacturer.
9.2: We warrant that the system we provide will comply with the order
9.3: All labour will be covered by a twelve (12) month warranty against the system failure or breakdown from the commissioning date.
9.4: You must inform the company as soon as you become aware of any malfunction or fault with your system.
9.5: Failure to inform us of a known fault will invalidate your warranty.
9.6: Any recommendations made by the manufacturer or Government legislation must be complied with.
Liability:
10.1: If any part of the system, sub-system or component or installation is damaged or defective it is your responsibility to inform us in writing immediately.
10.2: Our total liability is limited to the amount set out in the order for the installation cost of the system. Potential claims excluding death or personal injury caused by our negligence.
10.3: We are not liable to you in any form, either direct or indirect, for any losses, either in profit, depletion of goodwill or otherwise.
10.4: Whilst we agree to administer warranty claims as paragraph 9.1, we are not liable for any claims.
10.5: We will not be liable for any faults / damage or otherwise due to misuse or negligence on your part to the system, sub-system or components used in the installation.
Ownership of goods & risk:
11.1: Goods are owned by us until full payment has been received. Payment received is taken to be the point at which monies has cleared into the company’s account(s).
11.2: Goods delivered to site prior to installation are the sole responsibility of you & are held at your risk.
11.3: If goods are delivered to the company / buyer, the company / buyer, will inspect the goods as per our quality management system. If you fail to inspect the goods in your charge at the point of delivery you have deemed to have accepted the goods. You will be liable for any replacement costs.
11.4: Once the system, sub-system or component is installed & commissioned all goods is your risk.
Force Majeure:
12.1: In the event that we are prevented from carrying out the order for a result beyond our control such as but not limited to: Acts of God, War, Strikes, Flood & failure of third parties, we shall be relieved of our obligations & liabilities to carry out & complete the order as long as we are prevented in doing so.
Complaints Process:
13.1: If you have a complaint about our service, please contact us. We will aim to resolve all complaints as quickly as possible. An inspection of your system will take place within a week of receiving your complaint in writing.
13.2: All complaints will be kept confidential.
13.3: In the event that we do not come to an agreement with you in relation to your complaint then an independent third party will be used to resolve any issues.
13.4: All complaints must be made within a reasonable time frame.
General:
14.1: All quotations, cost estimates & relevant contract paperwork will be written in English.
14.2: All contract agreements operate under English Law.
14.3: If any of the terms of business is found to be illegal or unenforceable, then the remaining terms of business shall remain valid.
14.4: These terms of business do not affect your statuary rights. Further details on your legal rights can be obtained at www.consumerdirect.gov.uk
14.5: We will not be held liable to you for any delay, loss or damage caused or suffered by you due to circumstances beyond our reasonable control, in relation to circumstances that continue for more than two (2) months, either you or the company may cancel the order.
14.6: All designs, copyright & / or intellectual property rights of any nature produced by us as part of fulfilling the order, are & remain the property of the company.
14.7: If we waiver a breach by you in relation to any of these terms of business all of terms of business are not affected. The waivered item shall not be used.
14.8: If the price of any product or service changes between receipt of order & despatch, we will notify you in writing, giving the opportunity to cancel the order & obtain a full refund.
14.9: If any act or proceeding begin in which your solvency is concerned, the full valve of all work completed & goods ordered or despatched or an order shall be immediately due for payment in full.
14.10: The performance of the microgeneration systems is impossible to predict with any certainty due to the variability of the climate & its subsequent effect on both heat supply & demand. This quotation / cost estimate is based upon the best available information but is given as guidance only & should not be considered as a guarantee.
